These Terms of Service ("Terms") govern your use of goldmistperfumes.com (the "Site") and your purchases from Gold Mist Perfumes Inc. ("Gold Mist", "we", "us", "our"). By using the Site or placing an order, you agree to these Terms.

You must be at least 18 years old to make a purchase. By placing an order, you confirm you are of legal age.

Products

Gold Mist offers inspired fragrance products. Our descriptions reference the original brands that inspired each scent. Gold Mist is not affiliated with, endorsed by, or sponsored by any named brand. All trademarks and brand names referenced are the property of their respective owners.

We make every effort to display product details accurately. Colors, sizes, and other details may vary slightly from product images.

Pricing and Payment

• All prices are listed in Canadian Dollars (CAD).
• Prices exclude shipping and tax, which are calculated at checkout.
• HST (13%) is applied to Canadian orders as required by Ontario tax law.
• We accept Visa, Mastercard, American Express, and other methods supported by Stripe. We do not store your full credit card number.
• Orders are not confirmed until payment is successfully processed.

We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or items being out of stock.

Shipping

We ship within Canada only. Specific shipping terms are governed by our Shipping Policy.

All Sales Final

All sales are final. We do not accept returns, refunds, or exchanges under any circumstances, including change of mind, dissatisfaction with the fragrance, or a change in size preference. By placing an order you accept this policy. See the All Sales Final policy in full.

This policy does not affect your statutory rights under applicable Canadian consumer protection law for products that are defective, dangerous, or materially misrepresented at the point of sale.

Fragrance Safety and Shipping Disclosure

Our perfumes contain alcohol-based fragrance components classified as Class 3 Flammable Liquids (UN1170) under Transport Canada's Transportation of Dangerous Goods (TDG) regulations. We ship these products under Canada Post's Limited Quantity exemption, which restricts each parcel to 500 mL or less of fragrance liquid and ground service only. Customers are responsible for storing and using fragrance products safely:

• Keep away from heat, flame, and direct sunlight.
• Store upright in cool, dry locations.
• Do not spray near open flames.
• Keep out of reach of children.

Intellectual Property

All Site content (text, images, logos, design) is the property of Gold Mist Perfumes Inc. or its licensors and is protected by copyright. You may not reproduce, distribute, or use Site content for commercial purposes without our written permission.

References to third-party brand names are made under fair-use and nominative-use principles to describe scent inspirations. No affiliation is implied.

User Conduct

You agree not to:

• Use the Site for any unlawful purpose.
• Attempt to gain unauthorized access to our systems.
• Use bots, scrapers, or automated tools to interact with the Site without permission.
• Submit false, misleading, or fraudulent orders.
• Interfere with other customers' use of the Site.

We may suspend or terminate your access to the Site for violations.

Limitation of Liability

To the maximum extent permitted by law:

• The Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, except as required by Canadian consumer protection law.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products.
• Our total liability for any claim arising from your purchase is limited to the amount you paid for the product giving rise to the claim.

These limitations do not exclude liability for fraud, willful misconduct, gross negligence, or matters that cannot be excluded under Canadian law.

Indemnification

You agree to indemnify and hold Gold Mist Perfumes Inc. harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of our products.

Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario, Canada.

Changes to These Terms

We may update these Terms from time to time. We will post the new version with an updated "Last updated" date. Continued use of the Site after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
